Terms of Service

Please read these terms carefully before using LandlordIQ.

The short version

  • Use LandlordIQ lawfully and in good faith — we reserve the right to suspend accounts that don't
  • Subscriptions are monthly and cancel at period end — no partial refunds
  • AI-generated content is for guidance only — always review before using in a legal context
  • Compliance status in the app reflects your answers and is not a legal guarantee
  • We limit our liability — for complex matters, seek independent legal advice

Acceptance of terms

By creating an account or using LandlordIQ, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the platform.

These Terms form a legally binding agreement between you and LandlordIQ Ltd ("LandlordIQ", "we", "us", "our"), a company registered in New Zealand.

We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated Terms.

The service

LandlordIQ provides a compliance management platform for New Zealand residential landlords, including:

·Healthy Homes Standards compliance assessment and tracking
·Property and tenancy document management
·Compliance statement generation
·Email reminders and notifications
·AI-assisted compliance guidance (Investor plan and above)
·Tenancy document builder (Investor plan and above)

We reserve the right to modify, suspend, or discontinue any feature of the platform at any time with reasonable notice to subscribers.

Account registration

To use LandlordIQ you must register an account. You agree to:

·Provide accurate, current, and complete information when registering
·Keep your login credentials secure and not share them with others
·Notify us immediately at hello@landlordiq.nz if you suspect unauthorised access to your account
·Be responsible for all activity that occurs under your account

You must be at least 18 years old to create an account. LandlordIQ is intended for use by New Zealand residential landlords and property professionals.

Subscriptions and billing

LandlordIQ offers the following subscription plans:

·Free — limited to 1 property, no payment required
·Solo — $19/month NZD, up to 3 properties
·Investor — $39/month NZD, up to 10 properties

Subscriptions are billed monthly in advance. All prices are in New Zealand Dollars (NZD) and are inclusive of GST where applicable.

Payments are processed securely by Stripe. By subscribing, you authorise LandlordIQ to charge your payment method on a recurring monthly basis until you cancel.

You may cancel your subscription at any time from your billing settings. Cancellation takes effect at the end of the current billing period — you will retain access until then. We do not provide refunds for partial billing periods except where required by the Consumer Guarantees Act 1993 or Fair Trading Act 1986.

We reserve the right to change subscription pricing with 30 days' notice. Price changes will not affect your current billing period.

Acceptable use

You agree to use LandlordIQ only for lawful purposes and in accordance with these Terms. You must not:

·Use the platform in any way that violates applicable New Zealand or international law
·Attempt to gain unauthorised access to any part of the platform or its infrastructure
·Use automated tools to scrape, crawl, or extract data from the platform
·Introduce malware, viruses, or other harmful code
·Impersonate another person or entity
·Use the platform to store or transmit content that is unlawful, defamatory, or infringes third-party rights
·Attempt to reverse engineer or decompile any part of the platform

We reserve the right to suspend or terminate accounts that violate these provisions without notice.

Your content

You retain ownership of all content you upload or create within LandlordIQ, including property details, documents, and compliance data ("Your Content").

By using the platform, you grant LandlordIQ a limited, non-exclusive licence to store, process, and display Your Content solely to provide the service to you.

You are responsible for ensuring that Your Content is accurate, lawful, and does not infringe the rights of any third party. We do not review or verify the accuracy of compliance assessments or documents you create.

AI-generated content

LandlordIQ includes an AI assistant and AI-powered document generation features (available on Investor plan). You acknowledge that:

·AI-generated content is provided for informational purposes only and does not constitute legal advice
·You are responsible for reviewing and verifying the accuracy of any AI-generated compliance statements, tenancy documents, or guidance before relying on or using them
·LandlordIQ does not warrant that AI-generated content is accurate, complete, or suitable for your specific circumstances
·You should seek independent legal advice for complex tenancy or compliance matters

The AI assistant uses Anthropic's Claude API. Do not enter sensitive personal information (such as tenant personal details or payment information) into the AI chat.

Compliance information

LandlordIQ is designed to help you track and understand your obligations under the Healthy Homes Standards and the Residential Tenancies Act 1986. However:

·The platform does not constitute legal advice
·Compliance requirements may change — you are responsible for staying up to date with current New Zealand law
·A "compliant" status in LandlordIQ reflects your self-reported answers and does not guarantee legal compliance
·LandlordIQ accepts no liability for fines, penalties, or other consequences arising from non-compliance with tenancy or housing legislation

We recommend seeking independent legal or professional advice for specific compliance questions.

Intellectual property

LandlordIQ and all associated content, trademarks, software, design, and features are owned by or licensed to LandlordIQ Ltd. Nothing in these Terms transfers any intellectual property rights to you.

You may not copy, reproduce, distribute, or create derivative works from any part of the platform without our prior written consent.

Privacy

Your use of LandlordIQ is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You can read our Privacy Policy at landlordiq.nz/privacy.

By using the platform you confirm that you have read and agree to our Privacy Policy.

Disclaimers

LandlordIQ is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

We do not warrant that:

·The platform will be uninterrupted, error-free, or free from viruses
·The information provided is accurate, complete, or current
·The platform will meet your specific requirements

Nothing in these Terms excludes or limits any consumer rights you may have under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 that cannot be excluded by contract.

Limitation of liability

To the fullest extent permitted by law, LandlordIQ Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to:

·Loss of data or documents
·Financial penalties or fines from regulatory authorities
·Loss of profits or business opportunities
·Costs of substitute services

Our total liability to you for any claim arising out of or relating to these Terms or the platform shall not exceed the total fees you paid to us in the 12 months preceding the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under New Zealand law.

Termination

You may close your account at any time from your account settings or by contacting us at hello@landlordiq.nz.

We may suspend or terminate your access to the platform immediately if:

·You breach these Terms
·We reasonably suspect fraudulent or unlawful activity
·We are required to do so by law

Upon termination, your right to access the platform ceases. We will delete your data in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination will do so, including intellectual property, disclaimers, and limitation of liability.

Governing law

These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms or your use of LandlordIQ shall be subject to the exclusive jurisdiction of the New Zealand courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
